We have made every effort to display product colors and details as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual color or appearance of the product.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in our service will be corrected.

3. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices are subject to change without notice. We reserve the right to modify or discontinue pricing at any time.

Payment is due at the time of purchase. We accept major credit cards, debit cards, PayPal, and other payment methods as indicated on our website. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

You agree to pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred, including applicable taxes and shipping fees.

In the event of a pricing error, we reserve the right to cancel any orders placed for products listed at an incorrect price, regardless of whether the order has been confirmed and your credit card charged.

All promotional offers, discount codes, and special pricing are subject to specific terms and conditions and may be modified or discontinued at any time.

4. Shipping

We ship FlexiGuard products to addresses within the United States and select international locations. Shipping times and costs vary based on your location and selected shipping method.

Estimated delivery times begin from the date of shipment, not the date of order placement. Delivery times are estimates only and cannot be guaranteed. We are not responsible for delays caused by shipping carriers, customs, or events beyond our control.

Risk of loss and title for all products purchased pass to you upon delivery to the shipping carrier. We are not responsible for lost, stolen, or damaged packages once they have been accepted by the carrier.

You are responsible for providing accurate shipping information. If a package is returned to us due to an incorrect address provided by you, additional shipping charges may apply for reshipment.

International customers are responsible for all customs duties, taxes, and fees imposed by their country. These charges are not included in our product prices or shipping costs.

5. Returns and Refunds

We want you and your dog to love your FlexiGuard Modular Dog Leash System. If you're not completely satisfied, you may return unused, undamaged products in their original packaging within 30 days of delivery for a full refund of the purchase price, excluding shipping costs.

To initiate a return, please contact our customer service team at the email address provided below. You will receive a return authorization number and instructions. Products returned without authorization may not be accepted.

Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product. We recommend using a trackable shipping method, as we are not responsible for return shipments that are lost in transit.

Refunds will be processed within 7-10 business days after we receive and inspect your returned item. Refunds will be issued to the original payment method used for the purchase.

Products that show signs of use, damage, or are not in resalable condition may be subject to a restocking fee or may not be eligible for return.

6. Product Warranty

FlexiGuard warrants that our modular dog leash systems will be free from defects in materials and workmanship for a period of one (1) year from the date of purchase. This warranty does not cover normal wear and tear, misuse, abuse, accidents, or damage caused by failure to follow product instructions.

If a defect covered by this warranty is discovered, we will, at our discretion, repair or replace the defective product free of charge. This warranty is non-transferable and applies only to the original purchaser.

To make a warranty claim, please contact our customer service team with proof of purchase and a description of the defect. This warranty gives you specific legal rights, and you may also have other rights that vary by jurisdiction.

7. Intellectual Property

All content on the FlexiGuard website, including text, graphics, logos, images, product designs, and software, is the exclusive property of FlexiGuard Modular Dog Leash System or its content suppliers and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

The FlexiGuard name, logo, and all related product names, design marks, and slogans are trademarks or registered trademarks of FlexiGuard. You may not use these marks without our prior written permission.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any content from our website, except as follows: your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials, and you may print one copy of a reasonable number of pages of the website for your personal, non-commercial use.

Any unauthorized use of our intellectual property may violate copyright, trademark, and other laws and may result in legal action.

8. Limitation of Liability

  • Any injury to persons or animals or damage to property arising from use of our products;
  • Unauthorized access, use, or alteration of your transmissions or content;

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO FLEXIGUARD FOR THE PRODUCT(S) IN QUESTION.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

Our products are intended to be used as directed and with proper supervision. You are responsible for ensuring that our leash system is appropriate for your dog's size, strength, and behavior, and for using the product safely and responsibly.

9. Indemnification

You agree to defend, indemnify, and hold harmless FlexiGuard Modular Dog Leash System and its subsidiaries, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our products or services;
  • Your violation of these Terms of Service;
  • Your violation of any third-party rights, including intellectual property rights;
  • Any harm caused to any third party, including injury to persons or animals.

10. Governing Law and Disputes

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms of Service or your use of our products or services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in Wilmington, Delaware, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

You agree to waive any right to a jury trial or to participate in a class action lawsuit against FlexiGuard.

11. Severability

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

12. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and FlexiGuard Modular Dog Leash System regarding your use of our website and products.
